This paper examines the role of the constitution designing process in pushing the democratic transition towards cooperation, rather than conflict, in light of the great uncertainty that characterizes the democratic transition process regarding the future. The study focuses on four successful cases of democratic transition (Poland, Chile, South Africa, and Indonesia) to identify the common factors that contributed to their success. Through its comparative approach, the study concludes that the process of constitution designing more socio-political than legal as it requires a great deal of bargaining and negotiations to achieve balance and harmony between the existing political and social actors. The splitting, renaming and merging of factions can lead to the start of new rivalries, or in some cases, end existing ones. A new faction may inherit the original faction's previous rivalries with other groups, and if a faction name change results in a total restructure, it may signal the end of the rivalry. However, this was not the case when Jabhat al-Nusra renamed itself Jabhat Fatah al-Sham, and later Tahrir al-Sham. It was considered a 'cosmetic' and superficial change because it did not develop a new structure. This article will shed light on exclusionary politics and the political ramifications of sectarianism caused by certain jihadist movements, such as Jabhat al-Nusra (presently known as Tahrir al-Sham), enabling us to analyse its practices, especially towards minorities, and sectarian ideologies present in Idlib, and which ultimately led to the expulsion of many who fled outside the governorate. The article also calls attention to the roles of regional and international powers in Idlib against the backdrop of opposition factions, and their physical and ideological influence on Islamist forces that frequently facilitated displacement within and outside the city.

Although the Justice and Development Party (AKP) victory in the 2015 Turkish municipal elections was generally expected, the percentage of votes surprised many, including the leaders of the party. This paper suggests that, despite the best efforts of opposition parties to manipulate a series of crises for the AKP, the voters were able to see past the political maneuvering and took action at the ballot box. By first examining the many factors that had been expected to impact the results, not least of which was its political timing, and the general sense that Turkey’s ruling party was set for victory, this paper explores the political situation in Turkey at the time of the elections, and probes the events leading up to the vote. It begins with events of the year prior, which had witnessed a series of crises for the AKP including: events in Gezi Park and Taksim Square, a series of leaked voice recordings that put leaders in compromising positions, allegations of corruption against some AKP ministers, and most importantly, an ongoing conflict between Prime Minister Recep Tayyip Erdoğan and his former ally and leader of the Gulen (Service) movement Fethullah Gülen. Each of these was expected to affect the AKP’s chances of maintaining a strong political position, and was used by the ruling party to bolster its own stance; a tactic that ultimately failed.
